The penalty phase resumed this week, where jurors will soon decide if the gunman convicted of killing 11 Jewish worshippers is eligible to face the death penalty. The prosecution’s witness returned to the stand testifying that the defendant has a personality disorder but doesn’t have a mental illness or delusions, and “had capacity for planning and premeditation” of the attack. Saga Over the Tito House Continues
The city’s Historic Review Commission approved a plan to preserve the Prohibition-era home in Uptown — but the garage where Rolling Rock beer was first sold will be demolished. Dallas-based Fountain Residential Partners presented development plans for the Uptown area that include more than 250 apartments and on-site parking. [TribLIVE]

Railroad Industry Sues Over Crew-Size Requirements
The Association of American Railroads is challenging an Ohio law from March mandating a two-person crew for freight trains. The railroad industry has argued that one-person crews “have been used safely for decades,” and that Ohio lacks the authority to impose this minimum. This legal challenge comes after a 50-car train derailment in February that caused a large fire and prompted an evacuation order in East Palestine, near the Pennsylvania border. The lawsuit was filed in U.S. District Court one day before it was set to take effect. [WESA]
